Utah Moped and Motor Scooter Laws

Utah law requires that every person operating a motorcycle on Utah public roads and highways must have in his/her possession a valid driver license with an endorsement for operating motorcycles.

By definition a motorcycle means every motor vehicle, other than a tractor, having a seat or saddle for the use of the rider and designed to travel with not more than three wheels in contact with the ground. By Utah definition mopeds and motor assisted scooters are designed for the ability to be propelled by human power alone, and are therefore exempted from the requirements of the driver to have a motorcycle endorsement.

House Bill 72S1 (passed in 2008) repeals all class M licenses as of July 1, 2008.

Effective July 8, 2008, a new rule will be in place which will require all new motorcycle riders to be restricted to riding a motorcycle based on the cc size of the motorcycle upon which the rider is tested. The following 3 restrictions will be used:

O = 90 cc or less Motorcycle
2 = 249 cc or less Motorcycle
3 = 649 cc or less Motorcycle

As for registration if the scooter or moped is over 50 cc's it would require registration. If the scooter is to be operated on public streets like a motorcycle it will need to pass state safety inspections. Otherwise it will need to follow the same rules and regulations as a bicycle.

If the vehicle is registered for street use it would require insurance.
