Motorized bicycle/moped means a vehicle equipped with two or three wheels, foot pedals to permit muscular propulsion or footrests for use by the operator, a power source providing up to a maximum of two brake horsepower having a maximum piston or rotor displacement of 3.05 cubic inches(49.98 millimeters) if a combustion engine is used, which will propel the vehicle, unassisted, at a speed not to exceed thirty miles(48.28 kilometers) per hour on a level road surface, and a power drive system that functions directly or automatically only, not requiring clutching or shifting by the operator after the drive system is engaged, and the vehicle may not have a width greater that thirty-two inches (81.28 centimeters).

Scooters, powered by an electric or gas engine, meeting the requirements of a motorized bicycle and operated on a highway must be titled and registered as a motorized bicycle. If it does not meet the requirements of a motorized bicycle or motorcycle, it cannot be titled or registered.

-- Motor Vehicle excise tax (5%) must be remitted when applying for title

-- Motorcycle-type license plate is issued

-- Liability insurance is required

The operator of a motorized bicycle must be at least 14 years of age and must have one of the following-- 39-06-14(5):

-- Operators license (minimum Class D, no motorcycle endorsement

required)

-- Temporary permit

-- Instruction permit

-- Motorized bicycle operators permit

-- Anyone under age 18 must wear a helmet

-- Traffic laws apply to operator - 39-10.2-01

SCOOTER REQUIREMENTS:

-- First and foremost it must be inspected. If it does not meet specs for a moped/motorcycle

it can not be titled or registered.

-- If a new vehicle an MCO is required along with the inspection, application, and appropriate fees.

-- If a used vehicle the out-of-state title, current ND title, or other state ownership proof is required (DNR

card, registration, etc.)

-- Fees same as for a Motorized Bicycle above
